Moro Residents In Sulu Hit Continued State Of Emergency In Their Province

The residents of Sulu petitioned the Supreme Court to lift the state of emergency rule in the Province of Sulu. Chairman Temogen Tulawie and his lawyer Atty.Jamar Kulayan led the petitioners in asking the Philippine Supreme Court for certiorari and prohibition urgently seeking a temporary Restraining Order (TRO) against the state of emergency in Sulu. On May 25, 2009, the court issued the notice for information signed by clerk of court Ma. Luisa Villarama, which gave the respondents ten days to answer the petition. Name respondents in the petition were Sulu Gov. Abdusakur Tan, General Juancho Sabban and Col. Eugenio Clemen, commander of 3rd Marine brigade in Sulu. Petitioners claimed that the state of emergency in Sulu is a gross violation of their fundamental freedom guaranteed by the Constitution as well as the very foundation of democratic system in the Philippines. The emergency rule was the government of Sulu’s counter measure on the spate of kidnapping incidents in the province. Governor Abdusakur Tan issued proclamation No. 01, placing the entire province of Sulu under the state of emergency on March 31, 2009. For the last 10 years, the government forces have been battling with the Abu Sayyaf in Sulu which has more or less 400 members only. But the government failed to crush the group and the military operations led only to perdition which caused the displacement of thousand of innocent people from several municipalities of the province.
